TERMS OF SERVICE

It is your responsibility to fully understand the terms and conditions for the retreat ("retreat" includes all yoga teacher trainings). Please read carefully what is and is not included in your retreat package and carefully review details on the website and sent via email leading up to the retreat. Should you have questions regarding the terms and conditions, we are available for consultation and happy to clarify any areas in advance of making a final payment.

 

PAYMENT TERMS & CANCELLATIONS

1. RETREAT PRICING

All prices are set in advance of the retreat start date in USD. Prices include only the items specifically stated in the description. The Host can offer discounts and price adjustments at their discretion.

2. RETREAT PAYMENT & DEPOSIT

Payment must be made through the website using a credit card, PayPal or available payment plans through Affirm (a 3rd party payment plan provider). If a non-refundable deposit is made, the remaining balance will be due no later than 4

weeks prior to the retreat start date. Participants will receive a reminder email one week prior to the due date. If full payment is not received by this deadline, we reserve the right to cancel your reservation and fill your spot. We will make every effort to avoid this situation by contacting you prior to the balance due date.

3. STRICT CANCELLATION POLICY

If you wish to cancel your retreat you must notify DEDICA, LLC (“The Host”) via email at hello@bydedica.com. There are no refunds on deposits. Refunds on Applications will be refunded only if you do not meet the training, mentorisip or retreat requirements. There are also no refunds on full or partial payments for retreat reservations. For extenuating circumstances preventing participation in the retreat please contact the Host (hello@bydedica.com) to potentially find a replacement guest to receive a partial refund at the Host's discretion. Exceptions to our cancellation policy cannot be made for ANY reason, including weather, terrorism, pandemics, civil unrest, health changes, personal emergencies, or otherwise. There is no refund for arriving late or leaving a retreat early.

5. TRANSFER POLICY

Reservations cannot be transferred from one retreat to another.

6. RETREAT CANCELLATIONS

The Host reserves the right to make any changes deemed necessary; including, but not limited to: advertised excursions, arranged transportation, advertised meals, etc. In the rare case of a  Retreat cancellation, The Host will offer a transfer to another retreat (if possible) or a full refund of your payment. The Host is not responsible for any expenses or damages incurred as a result of retreat cancellation including but not limited to preparation costs, airline tickets, travel documents or other expenses. The Host reserves the right to cancel any retreat in the event that there are too few people booked, in which case you will be given a full refund of any and all payments made to The Host. You will not be entitled to claim any additional amounts or seek any compensation for any injury, loss, expenses or damages (either direct or consequential) or for any loss of time or inconvenience which may result from such cancellation (including but not limited to visa, passport and vaccination charges, or departure, gear purchases, airport and airline taxes).

8. TRAVEL DOCUMENTS

For retreats held outside the U.S., all passport holders are required to have at least 6 months of validity on their passport at the time of travel.  Information regarding necessary documentation is provided as necessary on our website or you can contact us for more detailed information. 

9. ROOMMATE ASSIGNMENTS

Retreat rates are based on room occupancy. A "2 occupant" or otherwise advertised shared rooms require both guests to share the room (usually a single queen or king bed) for the specified room rate. If you book a shared room you are required to confirm your roommate within 30 days of booking to qualify for the stated room rate and ensure both occupants have access to the retreat. In the event that a roommate is not confirmed (with their proof of payment if paying separately), you will be required to pay the difference between the shared (2 occupants) and single (1 occupant) room rate to avoid termination of your reservation WITHOUT refund. This means that if there is no roommate, you will have to pay the full room cost of a "1 occupant" room.

 

ACKNOWLEDGEMENT

10. ASSUMPTION OF RISK

I acknowledge that I have voluntarily enrolled to participate in this retreat. In consideration of The Host allowing me to participate, I agree to this release of claims, waiver of liability, and assumption of risks. On behalf of myself, my heirs, executors, successors, administrators, and any other person who may have an interest at common law or by operation of statute, I hereby waive any and all claims I or such parties may have now or in the future. I release from liability The Host and any teachers, employees, guides, agents or representatives (“the releasees”) for any personal injury, death, property damage or loss of any nature suffered as a result of participation in any activity during the retreat. I release from liability The Host for any cause whatsoever including those arising out of, or in any way connected to or occasioned by the negligence of the releasees.

RELEASE OF LIABILITY

11. HEALTH DISCLOSURE & PARTICIPANT ELIGIBILITY 

Participant represents and warrants that all health information provided to DEDICA is complete, accurate, and current. Participant agrees to disclose any physical injury, chronic medical condition, recent surgery, pregnancy, allergy, mental health condition, psychiatric diagnosis, prescribed medication, or other circumstance that may affect participation, safety, judgment, mobility, emotional wellbeing, or the safety and wellbeing of other participants.

Participant acknowledges that DEDICA relies upon the accuracy of such disclosures when determining eligibility for participation. Failure to disclose relevant health information, or providing incomplete or inaccurate information, may result in removal from the retreat, training, or related activities without refund.

Participant assumes full responsibility for any risks, injuries, losses, damages, or complications arising from undisclosed, inaccurately disclosed, or newly developed medical, physical, emotional, or psychological conditions.

12. MENTAL & EMOTIONAL WELLBEING AKNOWLEDGEMENT 

Participant understands and acknowledges that yoga, meditation, breathwork, personal development practices, self-inquiry exercises, group discussions, immersive retreat experiences, and other wellness activities may evoke strong emotional responses, psychological stress, anxiety, grief, trauma-related reactions, or other mental and emotional experiences.

Participant affirms that they are mentally and emotionally capable of participating in the program and accepts full responsibility for monitoring and managing their own mental and emotional wellbeing throughout the retreat or training.

Participant understands that DEDICA, its instructors, facilitators, and staff are not licensed mental health professionals and do not provide psychotherapy, psychiatric treatment, counseling, crisis intervention, or other mental health services.

13. MEDICATION & HEALTH MANAGEMENT ​

Participant is solely responsible for managing, storing, transporting, and properly taking any prescription medications, over-the-counter medications, supplements, or medical devices required during participation.

DEDICA does not provide medical supervision, monitor medication use, verify medication compliance, or assume responsibility for the effects, side effects, interactions, misuse, or non-use of any medication or treatment.

Participant assumes all risks arising from the use, non-use, timing, dosage, side effects, interactions, or failure to disclose any medication or treatment.

14. PARTICIPANT DUTY TO SELF-MONITOR

Participant agrees to participate only to the extent that they feel physically, mentally, and emotionally capable. Participant agrees to immediately stop or modify any activity that causes pain, dizziness, shortness of breath, discomfort, emotional distress, or other concerning symptoms.

Participant further agrees to promptly notify DEDICA staff of any injury, illness, medical concern, emotional distress, or change in health status that may affect participation.

15. EMERGENCY MEDICAL CARE AUTHORIZATION

In the event of illness, injury, accident, or medical emergency during participation, Participant authorizes DEDICA and its representatives to seek, arrange, or obtain emergency medical treatment deemed reasonably necessary.

Participant understands that DEDICA has no obligation to provide medical care and makes no guarantees regarding the availability, quality, or timeliness of emergency medical services.

Participant accepts full responsibility for all medical expenses, transportation costs, evacuation expenses, hospital charges, physician fees, prescription costs, and any other expenses arising from such treatment.

16. RIGHT TO REFUSE OR TERMINATE PARTICIPATION

DEDICA reserves the right, in its sole discretion, to deny participation, remove, suspend, or terminate the participation of any individual whose conduct, health condition, mental state, substance use, behavior, or actions are deemed unsafe, disruptive, threatening, inappropriate, or detrimental to the wellbeing of themselves, other participants, staff, or the overall retreat or training experience.

Any removal, suspension, or termination under this provision shall not entitle the participant to any refund, reimbursement, credit, compensation, or damages.

17. NO MEDICAL OR PSYCHOLOGICAL ADVICE 

Participant understands and agrees that DEDICA, its instructors, facilitators, employees, contractors, and representatives do not provide medical advice, psychological advice, psychiatric services, counseling, diagnosis, treatment, or healthcare services of any kind.

Any information, instruction, guidance, recommendations, educational content, wellness practices, or discussions provided during the retreat or training are for educational and informational purposes only and are not intended to replace professional medical, psychological, or mental health care.

Participant is solely responsible for consulting qualified healthcare providers regarding any medical, physical, psychological, emotional, or mental health concerns.

18. EXTENSION OF RELEASE TO THIRD PARTIES

Participant agrees that all releases, waivers, assumptions of risk, indemnifications, and limitations of liability contained in these Terms and Conditions shall apply not only to DEDICA, but also to its owners, directors, officers, employees, contractors, instructors, guest teachers, volunteers, affiliates, agents, retreat venues, hotels, property owners, transportation providers, excursion operators, service providers, and any other third parties involved in the planning, organization, facilitation, or operation of the retreat or training.

19. EXPRESS ASSUMPTION OF RISK

I, the guest, am aware that there are significant risks involved in physical training, horseback riding, and outdoor activities, including but not limited to, the training inherent to all yoga and physical fitness, and that my participation in any such activities carries with it the potential for death, injury, and/or property damage. The risks include but are not limited to, falls which can result in serious injury or death; injury or death due to negligence on the part of the Host, training partners, or other people around me; injury or death due to improper use or failure of equipment; strains and sprains; those risks caused by terrain, facilities, temperature, weather, condition of athletes, equipment, vehicular traffic, actions of other people including, but not limited to, participants, volunteers, spectators, coaches, and trainers and lack of hydration. These risks are not only inherent to physical training and activities but are also present for volunteers and spectators. I am aware that any of these above-mentioned risks may result in serious injury or death to myself and or my partner(s). I willingly assume full responsibility for the risks that I am exposing myself to and accept full responsibility for any injury or death that may result from participating, volunteering or watching in any training or activities. I realize that liability may arise from negligence or carelessness by the persons or entities being released, from dangerous or defective equipment or property owned, maintained or controlled by them or because of their possible liability without fault. I acknowledge that I have no physical impairments, injuries, or illnesses that will endanger me or others.

I acknowledge that I am willingly participating in these activities and that I have assumed all risks as described above. In consideration of my being allowed to participate in the activities offered, I, the Guest, hereby release The Host, their principals, teachers, agents, employees, and volunteers from any and all liability, claims, demands, actions or rights of action, which are related to, arise out of, or are in any way connected with my participation in this activity, including those allegedly attributed to the negligent acts or omissions of the above-mentioned parties. This agreement shall be binding upon me, my successors, representatives, heirs, executors, assigns, or transferees. If any portion of this agreement is held invalid, I agree that the remainder of the agreement shall remain in full legal force and effect. If I am signing on behalf of a minor child, I also give full permission for any person connected with the hosting organization to administer first aid deemed necessary, and in case of serious illness or injury, I give permission to call for medical and or surgical care for the child and to transport the child to a medical facility deemed necessary for the well being of the child.

Indemnification: The participant recognizes that there is risk involved in the types of activities offered. Therefore the participant accepts financial responsibility for any injury that the participant may cause either to him/herself or to any other participant due to his/her negligence. Should the above-mentioned parties, or anyone acting on their behalf, be required to incur attorney’s fees and costs to enforce this agreement, I agree to reimburse them for such fees and costs. I further agree to indemnify and hold harmless The Host and the hosting organization (DEDICA, LLC), their principals, agents, employees, and volunteers from liability for the injury or death of any person(s) and damage to property that may result from my negligent or intentional act or omission while participating in activities offered. This includes but is not limited to the entire retreat venue, outdoor areas, parks, recreational areas, playgrounds, areas adjacent to the retreat venue, and/or any area selected for training.

MEDIA

20. PERMISSION FOR CAPTURE AND USE

Media is defined as photography, video, written or verbal testimonial, or any other form of capturing likeness. For valuable consideration received, I grant to The Host the absolute and irrevocable right and unrestricted permission concerning any captured media that she/he has taken or may take of me or in which I may be included with others, to use, reuse, publish, and republish in whole or in part, individually or in connection with other material, in any and all publishing platforms now or hereafter known, including the Internet, and for any purpose whatsoever, specifically including illustration, promotion, art, editorial, advertising, and trade, without restriction as to alteration; and to use my name in connection with any use if she/he so chooses. I release and discharge The Host from any and all claims and demands that may arise out of or in connection with the use of the media, including without limitation any and all claims for libel or violation of any right of publicity or privacy. This authorization and release shall also extend to the benefit of the heirs, legal representatives, licensees, and assigns of Photographer, Videographer, Interviewer, Editor, as well as the person(s) for whom he/she captured the media. I am a legally competent adult and have read this document and fully understand its contents. This release shall be binding upon me and my heirs, legal representatives, and assigns.

WAIVER

21. RELEASE AND WAIVER OF LIABILITY

I hereby agree that I, my assignees, heirs, distributees, guardians, and legal representatives will not make a claim against, sue or attach the property of The Host (DEDICA, LLC), their affiliates, teachers, employees, agents or volunteers or any of their affiliated organizations for injury or damage resulting from acts, howsoever caused, by any employee, agent, or contractor, or any of their affiliated organizations, as a result of my participation in The Host’s retreats. I hereby release The Host, and any of their agents or affiliated organizations from all actions, claims or demands that I, my assigns, heirs, distributees, guardians, and legal representatives now have or may hereafter have for injury, damage, or death resulting from my participation in The Host’s retreats.

I am medically, physically, emotionally, and in all respects fit and able to participate in The Host’s retreats.

I agree I will be fully and financially responsible for my own physical condition and well-being during the retreat and will follow the safety precautions and instructions prescribed by The Host.

I acknowledge that The Host may make suggestions from time to time that is intended to help me and my well-being.

 

However, I take ultimate responsibility for my choices and realize that The Host is not a licensed medical provider and that I must consult my doctor.

If I experience pain or discomfort during the retreat, I will modify The Host’s instructions to suit my individual needs. I will not hold The Host responsible for any pain or discomfort I experience during or after the retreat. I understand that the activities offered on this retreat are not a substitute for medical care. I understand that The Host is not qualified to perform spinal or skeletal adjustments, diagnose, prescribe, or treat physical or mental illness.

22. SUBSTANCE USE POLICY 
By enrolling in a DEDICA Retreat or intensive Yoga Teacher Training program, I acknowledge and agree that the use of alcohol, recreational drugs, or any intoxicating substances during the training period is strictly prohibited. Participation under the influence of such substances is considered a serious breach of conduct and may result in immediate dismissal from the program and forfeiture of your diploma. This policy is in place to ensure a safe, respectful, and focused learning environment for all participants.

By agreeing to the terms outlined here and elsewhere on The Host’s website I hereby release and discharge my rights and claims for damages or liabilities that may occur as a result of participation in The Host’s retreat.

This Agreement shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of laws rules.
